RE: The tariff classification of Yamaha Optical Digital Cable from Malaysia

Dear Mr. heck:

In your letter dated November 6, 2006 you requested a tariff classification ruling.

Yamaha optical digital cable, part number MX605220, is described as fiber optical cable. It is used to connect a DVD1000 DVD player to a monitor/television. A sample was submitted with your request for a ruling. The sample consists of a single glass fiber with an outer coating. The submitted sample is approximately 40 inches long and has connectors at each end. Light is guided through the fiber optic from a light emitting diode (LED) and sent along the fiber optic to an LED receptor.

You have suggested that the item is classified under heading 8544, Harmonized Tariff Schedule of the United States (HTSUS), which provides for optical fiber cables, made up of individually sheathed fibers, whether or not assembled with electric conductors or fitted with connectors, optical fiber cables. The National Import Specialist responsible for heading 8544, HTS, states that the submitted item does not meet the definition of optical fiber cable of heading 8544, HTS. Accordingly, the submitted sample is not classified under heading 8544, HTS.

The applicable subheading for the optical digital cable, part number MX605220 will be 9001.10.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for optical fibers, optical fiber bundles and cables, optical fibers, for transmission of voice, data or video communications. The rate of duty will be 6.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
